Brady v. the Steamship African Queen

179 F. Supp. 321 · District Court, E.D. Virginia · 1960

Facts

The Steamship African Queen grounded off Ocean City, Maryland, in December 1958, splitting into bow and stern sections, and was abandoned by its owners and underwriters in February 1959. Warner first boarded the stern section on March 11, 1959, and subsequently published a legal advertisement asserting sole possession and sent a letter threatening litigation. However, Warner took no further action to salvage the vessel. Libellants Deir and Little, with financial backers Brady and Sadler, first visited the stern section on March 14, 1959, and continuously remained aboard or had representatives there from March 17, 1959. They performed all salvage operations, expending approximately $112,000, and successfully towed the stern section to Norfolk by September 27, 1959.

Issue

Did Warner's initial boarding, legal notice, and threat of litigation establish a superior legal right as a finder or salvor to the stern section of the abandoned vessel, thereby precluding the claims of the libellants who actively performed the salvage operations?

Holding

No, Warner's actions were insufficient to establish a valid claim as a finder or salvor. The libellants, having successfully performed the salvage operations, are entitled to the entire proceeds from the sale of the stern section, as their services exceeded its value and they did not wrongfully interfere with any prior legal rights of Warner.

Rule

A party asserting a salvage claim must demonstrate not only initial possession but also a present intention to conduct salvage operations, immediately followed by constructive steps to aid the distressed property. Merely boarding a vessel and publishing a notice, without actively pursuing salvage, is insufficient to establish sole possession or a superior claim. The court also suggests that the doctrine of equitable estoppel may apply against a party who waits for others to perform salvage before asserting a claim.
